Climate Change Case Decided
09.21.09 6:27 AMToday, the Second Circuit issued its long awaited opinion in Connecticut v. American Electric Power Company, Inc., et al. The decision determined that the eight plaintiff States in this case had standing to bring federal common law nuisance claims related to global climate change. The suit aimed to force the defendants to cap and ultimately reduce their C02 emissions. The TVA was one of the defendants in this case. As you can imagine, this case is likely to have major ramifications that will affect a limitless amount of potential defendants. More later…
